Article 42
Right to Social Justice

(1) Economically, socially or educationally backward women, Dalits, tribal tribes, Madheshi, Tharu, Muslims, backward classes, minorities, marginalized, disabled persons, gender and sexual minorities, farmers, workers, citizens of oppressed or backward areas and Economically disadvantaged Khas Aryas will have the right to participate in state bodies based on the principle of proportional inclusion. Amended by First Amendment.
(2) For the protection, upliftment, empowerment and development of economically disadvantaged and endangered citizens, they will have the right to receive special opportunities and benefits in education, health, housing, employment, food and social security.
(3) Citizens with disabilities will have the right to live with dignity and self-respect, including recognition of diversity, and equal access to public services and facilities.
(4) Every farmer shall have the right to have access to the land for agricultural work according to the law, to choose and preserve traditionally used and adopted local seeds and agricultural varieties.
(5) All people's movements for progressive democratic change in Nepal, the families of martyrs who sacrificed their lives during the armed struggle and revolution, the families of disappeared people, the warriors of democracy, the victims of conflict and the displaced, the disabled, the injured and the victims with justice and due respect, education, health , will have the right to get priority opportunities in employment, housing and social security according to the law.
